ARBITRATION AGREEMENT

1. Arbitration agreement part of Terms of Service.
This Arbitration Agreement is in addition to the Terms of Service of BCBEXCHANGE.COM found here and are incorporated in them. By signing the Terms of Service, Customer acknowledges that this agreement contains an arbitration clause and that Customer has received, read and understood the terms thereof. BCBEXCHANGE.COM maintains the right to update these terms in accordance with the developments of the Service.

2. Customer acknowledgement:
Customer agrees that any controversy, dispute, claim, or grievance between customer and BCBEXCHANGE.COM or any BCBEXCHANGE.COM affiliate or any of the shareholders, officers, directors, employees, associates, or agents on the one hand and Customer or, if applicable, Customer's shareholders, officers, directors, employees, associates, or agents on the other hand, arising out of, or relating to the BCBEXCHANGE.COM Terms of Service, or any Account(s) established according to those Terms of Service in which digital assets may be traded; any transactions therein; any transactions between BCBEXCHANGE.COM and Customer; any provision of the Terms of Service or any other agreement between BCBEXCHANGE.COM and Customer; or any breach of such terms or agreements; shall be resolved first and foremost through negotiations.

3. Stranded negotiations:
If the negotiations stipulated in clause 2 of this Arbitration Agreement do not result in a resolution, the dispute will be referred to and finally solved in the Arbitration Court of the Estonian Chamber of Commerce and Industry in Tallinn (hereinafter “ Arbitration Court”) on the basis of the regulations of the Arbitration Court. The dispute will be settled according to the Laws of Estonia.

4. Arbitration agreement:
By signing this arbitration agreement, the parties also agree as follows:
i. The Rules of The Estonian Court of Arbitration in Estonian Chamber of Commerce and Industry shall apply.
ii. The seat of arbitration shall be The Estonian Court of Arbitration in Estonian Chamber of Commerce and Industry.
iii. The Arbitration Tribunal shall be composed of a sole arbitrator appointed by consent of the parties.
iv. If the Arbitration Tribunal is not established by the Parties in accordance with this clause due to lack of consent between the parties, the Arbitration Tribunal will be established by the Board of the Arbitration Court of the Estonian Chamber of Commerce and Industry.
v. The language to be used in the arbitration proceedings shall be English.
